Terms of Use

§1 Introduction

1.The Service presented to you is of a social nature and is a means of distance communication. It enables guests and registered
Users to present and browse announcements; however, it is neither a party nor an intermediary. The content of published listings is for information purposes only and
may not be regarded as a commercial offer. The Service is intended solely and exclusively for adults. It was created for people wishing to establish closer acquaintances, seeking company, or seeking persons with whom they could spend time together in
a manner to which they consent. The Roksati.pl Service is free of charge, which means that
both browsing the content of the Service and adding one's own content are free of charge.
By using the Service, Users accept the provisions of these Terms of Use
and declare that they:
1.1. Have reached the age of majority, i.e. are at least 18 years of age, or have attained majority in accordance
with the laws applicable in their country of residence;
1.2. Undertake not to make the content of the Service available to minors;
1.3. Confirm that by using this Service they do not violate the laws
in force in their country of residence;
1.4. Understand the provisions of these Terms of Use and confirm that, in using the
Service, they bear sole responsibility for their actions;
1.5. Release the Service, its Administrator, its Moderators, the Editorial Team and third
parties from any and all liability that may arise from the use of this
Service;
1.6. Are aware that all content published in the Service is subject to the regime of the Act of 4 February 1994 on Copyright and Related Rights, and declare that they will not infringe the copyrights of other persons (in particular, they will not download, copy, save, cut and paste, sell, license, rent, lease, modify, distribute, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from
materials or content found in the Service or from this Service without the prior consent of the actual owner(s) of such content or materials).

§ 2 Definitions

Administrator – the Roksati.pl Service, e-mail: [email protected] ;
Service – the website located at: www.roksati.pl;
User – a person who has reached the age of 18, as well as any other Entities granted legal personality by specific provisions of law, who use the services provided by the Service;

Account – a set of resources in the Service individualised for a specific User, identified by a unique login.

§3 Reservations

1.It is strictly prohibited in the Service to offer paid sexual services, to suggest that services are paid, to offer sponsorship or material benefits in exchange for sexual services, or to state prices or rates in announcements.
2. Graphic or text material posted by a User in the content of a listing may not include content indicating the offence of pornography, procuring, pimping, or use of the Service to facilitate unlawful activity.
3.It is prohibited to post in listings erotic photographs involving animals or texts about animals and sex.
4.The Administrator shall not be liable for the content of announcements published in the Service, or for their authenticity or timeliness.
5.The User bears unlimited liability for the content of materials entered into the Service and for the consequences of entering them with respect to third parties.
6. The Service shall not be liable for the content of private messages or of messages exchanged between Users of the Service in the chat available in the Service.
7. It is prohibited to copy any part or content of the Service without the written consent of the Administrator.
8. It is prohibited to disseminate through the Service, in any form, content that is unlawful, offensive or otherwise contrary to the principles of community life.
9. Users are prohibited from providing information that is knowingly misleading.
10. It is prohibited to advertise products, services or companies without the prior consent of the Administrator.
11. Any other action to the detriment of the Service or its Users is prohibited.

§ 4 Users

1.Each User may register in the Service in order to create an individualised Account.
2.By registering in the Service, the User consents to the processing and use of the data provided by the Administrator.
3.During the registration of a User in the Service, Users' personal data subject to legal protection are not made available or disclosed to third parties and are not transferred outside the European Union – except where the transfer of data is necessary for the performance of the agreement concluded between the Service and the User; this concerns:
- persons authorised by the Service – including employees and associates who, due to the scope of their competences, use the personal data provided to the Service by Users,

- the hosting company,
- the company handling mailings,
- the company handling SMS messages,
- companies with which the Service cooperates in the field of its own marketing,
- couriers,
- insurers,
- law firms and entities engaged in debt collection,
- banks,
- payment operators,
- public administration authorities and law enforcement authorities – solely on the basis of a formal request for disclosure of such data, grounded in the applicable provisions of law.
3.By registering in the Service, the User consents to the processing and use of the data provided by the Administrator.
4.Registered Users have access to certain resources and functionalities of the Service that are unavailable to unregistered Users, such as, for example, adding announcements.
5.The scope of access to the Service may be changed by the Administrator at any time.
6.The Account of a registered User who violates the Terms of Use, or an Account used for logging in in order to circumvent the security of the Service, may be deleted without notice.
7. By adding a listing, the User declares that:
– the information contained in its content is true,
– the contact details and photographs relate exclusively to the author of the listing,
– the content and data contained in the listing do not in any way infringe the rights of third parties.

§ 5 Limitation of the Administrator's Liability

1. Due to the lack of legal tools for comprehensive verification of the personal data provided by Users, the Service shall not be liable for the reliability and content of announcements published by Users, the content of comments, the content of private messages exchanged between Users, or the content of messages exchanged between Users in the chat made available in the Service.
2. The Service shall not be liable for limitations in its functioning or for the temporary or permanent suspension of the operation of the service resulting from technical problems.

§ 6 Powers of the Administrator

1. The Administrator reserves the right to:
a) refuse to publish announcements and any other content published by Users if there is a suspicion that they are contrary to the Terms of Use, applicable law or the principles of community life,

b) discontinue the provision of services, add new ones, or change their nature or functionality,
c) introduce additional requirements for meeting the conditions of use of a specific part of the Service's resources,
d) block or delete the Accounts of Users who do not comply with the provisions of the Terms of Use of the Service,

- the above-mentioned violations entitle the Administrator to remove photographs, Accounts, comments, messages and any publications in the Service.
2. Where non-compliance with the Terms of Use of the Service is found, the Administrator may:
a) correct the content of the listing so that it remains in compliance with the Terms of Use,
b) refuse to publish the listing,
c) remove a listing that violates the Terms of Use,
d) block the account and the IP address of the user in the event of repeated violations of the Terms of Use.

3. The Administrator makes every effort to ensure that the data of registered Users are properly secured.
4. The Administrator shall not be liable for the loss of registered Users' data caused by a technical failure or theft.

§ 7 Adding and Publishing Listings

1. The Service enables announcements to be added for a specified period, exclusively by adults.
2. Listings are displayed randomly, so that everyone browsing them sees them in a different order.
3. A photograph must be added to a listing. Listings without photographs will not be accepted.
4. In announcements by women, photographs are subject to editing and the face is covered.
5. In announcements by men, photographs appear without any editing or covering of the face.
6. At the express request of the person who added it, a listing may be removed from the Service by the Administrator before its expiry date.
7. The person posting a listing consents to:
- the dissemination of its content, photographs and contact details through publication in the Roksati.pl website and sister portals;
– the placement of the address or logo of the Service on the photographs published in the listing;
– the correction of the content or removal of part of the listing by the Administrator or a Moderator in order to correct or remove errors relating to the rules of spelling and of publishing content on the Internet and in the Roksati Service;
– the correction of the content or removal of part of the listing by the Administrator or a moderator if a violation of the Terms of Use of the Service is found.

8. Upon expiry of its validity period, a listing is automatically moved to the archive. A listing in the archive is not visible on the pages of the Service.
9. The Editorial Team of the Service reserves the right to refuse to publish a listing without giving any reason.
10. The Editorial Team of the Service reserves the right to refuse to publish a listing submitted in a grossly negligent manner, i.e. with exceptionally poor content, contradictory information, or accompanied by exceptionally low-quality
photographs.

§ 8 Final Provisions

1. The Service reserves the right to introduce amendments to the above Terms of Use. Use of the Service constitutes acceptance of the Terms of Use in their current wording.
2. An amendment to the Terms of Use enters into force upon publication of the amended version of the Terms of Use in the Service.
3. The Administrator reserves the right to introduce restrictions on the use of the Service by Users, which may result from work on improving its functionality or from technical maintenance.
4. Any disputes between the Administrator and Users shall be resolved amicably. If it is not possible to reach a settlement, the court competent to hear the dispute shall be the court having jurisdiction over
the registered office of the Administrator.
5. In matters not regulated by these Terms of Use, the provisions of the Act of 23 April 1964 – the Civil Code shall apply.
6. Notwithstanding the foregoing, cases of breaking the law, impersonating other persons, or acting to the detriment of the Service or other persons will be reported to law enforcement authorities. This applies to all listings in which the use of another person's photographs has been proven.
